Terms and Conditions

The purpose of this policy and standard is to establish the regulatory guidelines for the administration of the programs (user licenses) acquired and to be acquired by our customers. In turn and in a complementary manner, they will have to:

  • Consolidate software regulatory needs in the short, medium and long term.
  • Control and value Artificial Dynamics's software assets at its discretion.

The present terms and conditions on the use of the software and the website, applies to all processes of acquisition, use, maintenance and renewal of any type of software installed for our customers. The policy must be followed by all individuals who interact with the product, being an implicit obligation in the general ones, that our customers are responsible for the misuse of the software for the purpose of their activity, so as to ensure compliance with the requirements, especially the protection of intellectual property and copyrights.

The purpose of these terms and conditions is to define the guidelines for the proper use of the software provided to our customers in order to commercialize them, encouraging their best use, the search for better cost-benefit alternatives and quality assurance.

Terms and Conditions

  1. Software License. - Contract by which an author or holder of the patrimonial rights of a work, software, authorizes the user to use such work and its associated resources; complying with a series of terms and conditions. The software licenses acquired by the end customer, in addition to defining the type of software, may also define elements such as:
    • Term: the duration in time during which the terms and conditions established in the license remain in force, which may be: (a) Specific term licenses (Lifetime, Requires Updates). (b) Indefinite term licenses (Lifetime, No Expiration). (c) Licenses without term specification (Its use expires). (d) Free Licenses (Free Software or free).
    • The use of the software: Licenses for server installation and end-user use by concurrency, client server licenses and licenses for web access use.
  2. User. - All individuals who, with or without a direct link to the end Customer, use the software.
  3. Source code. - Text written according to the syntax, semantic and pragmatic rules of a programming language and that can be used for such devices to perform a set of tasks of interest to the user. The above are divided into:
    • Open Source Software: A software work is considered to be open source when the license under which it is distributed guarantees that the user: (a) may use the software work for any purpose (b) may distribute the program to other users (c) has access to the source code and may modify it. (d) may distribute the modified program.
    • Free Software: A software work is considered free when the license by which it is distributed exalts the values of user freedom and social solidarity; and guarantees that the user: (a) may use the software work for any purpose (b) may distribute the program to other users (c) has access to the source code and may modify it (d) may distribute the modified program.
    • Public Domain Software: Public Domain Software is software whose proprietary rights belong to the community and may be used without restriction. Some types of copies or modified versions may not be free if the author imposes additional restrictions on redistribution of the original or derivative works.
    • Freeware: Software works that allow free use, distribution, but not modification.
    • Proprietary Software: Software whose copying, redistribution or modification is restricted by the copyright owner.
    • Evaluation software: Proprietary software with a license that grants a reduced term of use -usually less than three months, and its main purpose is for the user to evaluate the functionality of the software before making the purchase, and once this period is over, it must be uninstalled.
  4. Intellectual Property. - Intellectual property is the most effective mechanism for the protection and encouragement of human creativity, since it recognizes that the author of the creative effort has the exclusive right to dispose of and exploit the result of such effort (the work). On the other hand, it should not be lost sight of the fact that computer programs constitute a fundamental element in the productive processes of the business sector. Most of the computer programs are intended to manage manufacturing, production, customer service and other processes related to business management.

Principles of terms and conditions

Adoption of software according to needs; Coordination of Information Technologies as a regulatory body, commitment to "Artificial Dynamics", considering Information and Communication Technologies from multiple approaches. The management and development of ICT transcend the vision, and become scenarios of collective construction that serve both for the satisfaction of internal needs, as well as for the formulation of models that can be applied in other contexts. In this sense, the Policy's guiding principle is the critical and rigorous analysis, adapted to the needs, of all processes related to the adoption and use of software by the end Customer.

The benefit, efficiency and effectiveness with respect to the support of "Artificial Dynamics" processes must be taken into account in all processes of acquisition, management, administration and use of the software. The software acquired, received or developed by "Artificial Dynamics" must make explicit the set of business processes it will support.

Software as an asset. The end customer must maintain at least a centralized repository and inventory, as well as a backup and security copy system that guarantees the knowledge, availability, integrity and efficient management of the software assets. All responsible users of computer equipment must know and have available the licensing information of the software in use in the equipment.

Follow-up of software assets. The final Client is informed that it must have a folder or electronic media with the updated inventory of software assets, as well as a purchase plan that contemplates the updating of the licensing as its expiration date is fulfilled, this as part of the policies of "Artificial Dynamics". In addition, the information related to the support and updating of the latter's products must be taken into account.

Promotion of Free Software. "Artificial Dynamics" promotes Free Software because its license reaffirms the principles outlined here. This type of software respects the freedom of the user, facilitates the transfer of knowledge and is based on solidarity and the democratization of access to knowledge, without violating the industrial and intellectual property rights that "Artificial Dynamics" has over the software.

Any user found to be in violation of any of these terms and conditions may be subject to disciplinary action, up to and including payment of damages, or referral to appropriate authorities for violations of state, federal or international law.
