Privacy Notice

Clause One.- This Privacy Notice (hereinafter, the "Notice") establishes the Terms and Conditions regarding the use of the technological platform comprised of a mobile capture device, mobile application, tracking map, administrator and business intelligence, hereinafter the "Platform", which Artificial Dynamics makes available to end users. The same contains the information indicated in the Federal Law for the Protection of Personal Data in Possession of Individuals in its articles 8, 15, 16, 17, section II, 33, and 36; in addition to what is indicated in its corresponding Regulation in articles 14, 24, 26, 27, 28, 30, 30, 40, 41, 42, 68, 90 and 102, and complying with the requirements indicated in the Privacy Notice Guidelines, more specifically in the Tenth, Eighteenth, Twentieth, Twenty-first, Twenty-second, Twenty-third, Twenty-fourth, Twenty-fifth, Twenty-sixth, Twenty-seventh, Twenty-eighth, Twenty-ninth, Thirtieth, Thirty-first, Thirty-second, Thirty-third, Thirty-seventh and Forty-first.

Clause Two.- The purpose of Artificial Dynamics's digital publications on the platform is to provide its customers with access to its services and products, as well as to information relating to such services, products and any other related information (hereinafter the "Services and Products").

Clause Three.- The use of the platform confers on clients the condition of user of the same (hereinafter, the "User") and implies full and unreserved acceptance of each and every one of the provisions included in this Notice in this version published by Artificial Dynamics en at the very moment that the User accesses the platform. Consequently, the User must read this Notice each time he/she uses the platform, as it may undergo modifications.

Clause Four.- The use of the platform is subject, in addition to this Notice, to all notices, regulations for use and instructions, which are brought to the User's attention by Artificial Dynamics through the platform.

Clause Five.- The use of certain Services and Products offered to Users through the platform may be subject to particular and specific conditions (hereinafter, the "Special Conditions") which, as the case may be, may replace, complete and/or modify this Notice. Therefore, prior to the use of such Services and Products, the User must read the corresponding Particular Conditions in question. Other Services and Products contained in the Platform may be subject to the User signing a written service agreement (hereinafter the "Service Agreement"), as well as the corresponding approval of Artificial Dynamics.

Clause Six.- Artificial Dynamics reserves the right to modify the Notice at any time and without prior notice. Such modifications will be effective from the time they are made available to customers using the platform. You are deemed to be aware of and bound by any changes to the Notice from the time you access the Platform. Use of or access to the Platform by the User will constitute acceptance of and agreement to the changes to the Notice. Similarly, Artificial Dynamics reserves the right to make changes to the information contained in its digital publications at any time.

Seventh Clause.- Artificial Dynamics will endeavor to ensure that the information contained in its platform is correct and up to date at the time it is included therein. However, it is possible that there may be unintentional errors or inaccuracies; therefore, Artificial Dynamics shall not be liable for errors or omissions contained in its platform, nor does it undertake to immediately update the information contained in its digital publications.

Eighth Clause.- Misuse and unauthorized use of the platform, including without limitation, unauthorized access to Artificial Dynamics's systems, misuse of passwords, or misuse of any information contained on the site, is strictly prohibited.

Clause Nine.- Artificial Dynamics may at any time deny, suspend or terminate the user's access to or use of the platform, any Service and Product, or any part thereof, based on suspicion of misuse of the same; this being understood as a discretionary and exclusive power of Artificial Dynamics, without the need for prior notice and without any limitation whatsoever. Based on the foregoing, Artificial Dynamics does not guarantee the usefulness, availability and continuity of the operation of the platform, as well as the Services and Products for the performance of any specific activity, or its infallibility, based on the protection of its intellectual property.

Tenth Clause.- For the User's convenience, the Platform may provide links ("Links") to other sites or pages on the Internet of third parties, the content or information of which is not reviewed by Artificial Dynamics. Except where expressly stated to the contrary, any page or site linked to our Platform is independent of Artificial Dynamics, and Artificial Dynamics has no control over such products, services, materials or any other information contained on or available through such third party page or sites, nor shall Artificial Dynamics be deemed to endorse such third party products or services that have a Link to our Platform. Access to any page or site linked to our Platform is at the user's own risk.

Clause Eleven.- Some Services and Products made available to the User through the page may require keys or passwords ("Passwords"), in order to verify the identity of the user. The user agrees that any operation correctly identified with such Passwords will be considered as validly performed by the user. Therefore, the User shall be solely responsible for maintaining the confidentiality of such Passwords, regardless of whether such Passwords are provided by Artificial Dynamics or selected by the User directly.

Clause Twelve.- Artificial Dynamics is the owner of all rights to the software of the digital publications, as well as of the industrial property rights relating to the content included in them, with the exception of rights to products and services that are not the property of Artificial Dynamics, whose trademarks are registered in favor of their respective owners, and as such are recognized by Artificial Dynamics. No material from the digital publications may be reproduced, copied, modified, distributed, transmitted, sold, used or published by the user without the prior written consent of Artificial Dynamics.

Clause Thirteenth.- All third party trademarks registered by their respective owners that appear on the platform will be only for the purposes of advertising and information gathering. Their owners may request the modification or elimination of the information concerning them. On the other hand, the appearance of these third party trademarks does not necessarily imply their recommendation.

Clause Fourteen.- Artificial Dynamics will scrupulously respect the confidentiality of the personal data provided by visitors to the digital publications, by observing its Notice and the applicable regulations in force, such that Artificial Dynamics will not provide the user's personal information to third parties, unless it is required to deliver a product or provide a service requested by the user.

Clause Fifteenth.- Notwithstanding the foregoing, and given the nature of the Internet, Artificial Dynamics does not guarantee that all use of the platform or Services and Products provided through the same is free of risk, and therefore Artificial Dynamics shall have no liability whatsoever, including damages, losses or any other that may be caused by the misuse by third parties of the information generated, received, transmitted or filed on the platform.

Clause Sixteen.- Any information sent by users and received on the platform, such as comments, suggestions or ideas, will be considered to be assigned to Artificial Dynamics free of charge, and the user who sends it implicitly accepts that it is not confidential. We suggest that you DO NOT SEND information that cannot be treated in this way. Artificial Dynamics shall have the right to use any information submitted for any purpose it deems appropriate.

Clause Seventeenth.- The User agrees to hold Artificial Dynamics harmless and indemnify Artificial Dynamics for any liability, cost or expense that may be charged to it for the use by the User of the Platform or the Services and Products for any prohibited or illegal purpose, or the violation of the rules of the same, any Service Agreement, any third party rights, including but not limited to copyright, industrial property rights, or any applicable federal, state or municipal law, regulation or code. Such obligations shall continue even after the termination of this Notice, Special Conditions or Service Agreement.

  • Other than as set forth in this Notice, Artificial Dynamics makes no warranties of any kind with respect to:
    • Own or third party information contained in the platform, including links and other means of information.
    • The availability and operation, inside and outside the Mexican Republic, of the materials, Services and Products contained in the platform, despite the fact that reference is made to them in the platform. Any user who chooses to access any of the components from other locations does so under his sole responsibility for compliance with local laws.
    • The accuracy or reliability of any information, content or advertising, linked or recorded through the platform, except as otherwise expressly set forth in any Service Agreement, nor the quality of any products, information or other materials obtained by the user as a result of any advertising, information or offer contained therein.
    • On any page or site to which the user has access through the platform.
    • On the privacy and security of the use of the platform and other Services and Products, nor that unauthorized third parties do not become aware of the use that users make of the aforementioned platform and subsequent Services and Products.

Clause Eighteen.- Finally, Artificial Dynamics is excluded from any kind of civil, criminal, administrative, or for direct or indirect damages, or any other damages caused by or derived from:

  • The presence of viruses or other harmful elements in the Services and Products provided through the platform or by third parties with links to it that may cause alterations in the information contained in the users' devices.
  • Errors or omissions contained in the platform, or use of the information contained therein. Any decision based on the information contained therein shall be the responsibility of the visitor.
  • The use or inability to use the platform, Services and Products or any part thereof, or their links, including any loss of programs or information, arising as a remedy for any breach.
  • The use and information available from any link to the Artificial Dynamics platform.
  • Access to the platform, the use of information or applications contained therein that could cause damage to the user's software or hardware.
  • Misuse by third parties of the information generated, received, transmitted, or stored on the platform.
  • Other that undermine the operation of the Artificial Dynamics platform as a result of the misuse of the Artificial Dynamics platform.
